WAIVER - Read Carefully Before Signing!

The undersigned acknowledges the inherent danger of close contact combat sports, and the risks involved in the participation and practice of martial arts.

The undersigned agrees that TBJJAFC, its agents, members, instructors (including but not limited to those volunteering, those acting as independent contractors, etc.) and employees, will NOT be responsible for accidents, injuries, or diseases of any kind, whether they were caused by or attributable to their negligence of any kind. The undersigned will indemnity and hold harmless TBJJA Fort Campbell LLC, its agents, members, instructors, and employees (collectively the "RELEASEES"), against all damage, loss or expense they or any of them incur as the result of any claim or action which may at any time be made or instituted against any of them.

The undersigned also agrees to the following practice rules:

1. Avoidance of any excessive force and contact.

2. Immediately stopping any activity and/or technique the participant considers unsafe and/or imprudent.

3. Notify instructor(s) if the undersigned participant is uncomfortable or unable to practice a specific technique, with a specific person or any aspect(s) of practice.

4. Follow personal hygiene accordance with CDC and/or local government guidelines, especially at the Academy.

   WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

   The undersigned understands the close personal contact involved in practice of Brazilian Jiu-Jitsu, and the inherent risks in such. The undersigned further represents & warrants and agrees to the following (and every time, the undersigned visits or attends the Academy, he or she re-iterates these representations):

   1. He/she is healthy to the best of their knowledge (i.e. they do not have communicable disease)

   2. To the best of their knowledge, he/she has not come into contact with) someone that has communicable disease within the last 3 weeks.

   3. Should they subsequently find out that they have gotten sick or they have been in contact who became sick and therefore potentially exposed students of the academy, they will promptly contact & inform the academy in writing (call or text to Academy Manager, e-mail to the Academy Manager is acceptable, social media messages are not adequate), providing the names to the best of their recollection of students they have had physical contact with.

   4. The undersigned agrees to maintain personal hygiene protocols suggested or mandated by CDC (Center for Disease Control) and local & state governments (hand washing, NOT touching eyes, mouth, nose etc.)

   1. Should the undersigned be concerned about exposure/training with another student, they will express their concern to the Instructor on the mats.

   2. The undersigned agrees that TBJJA Fort Campbell LLC, its agents, members, instructors (including but not limited to those volunteering, those acting as independent contractors etc.) and employees, will not be responsible for accidents, injuries, or diseases of any kind, whether they were caused by or attributable to their own negligence of any kind. The undersigned will indemnify and hold harmless TBJJA Fort Campbell LLC, its agents, members, instructors and employees, against all damage, loss or expense(s) which they or any of them incur as the result of any claim or action which may at any time be made or instituted against any of them.

   ASSUMPTION OF RISK/WAIVER OF LIABILITY/ INDEMNIFICATION AGREEMENT
   in consideration of being allowed to participate in Brazilian Jiu-Jitsu, Submission Grappling and Mixed Martial Arts in the TBJJA Fort Campbell LLC programs and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

   1. Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, staff, ring worm, influenza, and COVID-19. While Academy rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and

   2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS. both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation; and,

   3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, | will remove myself from participation and bring the hazard to the attention of the nearest Instructor immediately; and,

   4. for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS TBJJA Fort Campbell LLC their officers, officials, contractors, employees, volunteers, other participants and if applicable owners and lessors of premises used to conduct TBJJAFC classes and events ("RELEASEES"), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

   I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
